Is
online poker in U.S legal?
"Even though the Attorney General’s
office has publicly taken the position that
the 1961 Wire Act forbids online poker,
in 10 years they have not put their money
where their mouth is. Why? The judiciary
(that is, the interpreting body) has already
held that the 1961
Wire Act doesn’t speak to poker."

Card Player magazine has a great article
(quoted above) on their website, written
by a member of their legal counsel, in regards
to online poker and what the laws are in
the United States. Main points from the
article and points about the new bill (
Unlawful Internet Gambling Enforcement
Act ) that just passed as an attachment
to the port security bill include:
- The Bill Does Not Make Online
Poker Illegal
- The Bill Constitutes Enforcement
Legislation
- The Bill Does Not Change Existing
Gaming Law
- Online Poker Is
Not Illegal
- The Current Hysteria Is Completely
Unfounded
- Some Online Sites Are Overreacting
Although we are not lawyers, it does not
yet appear to be illegal to play online
poker in the USA, as the Unlawful Internet
Wiring Act did not change the 1964 Wire
Act. The bill simply made it illegal for
banks to do business with online merchants
involved in online gambling (IE, NETeller,
the old major deposit method).Click to read
